Data Protection Act – Step 4 – Issue Proceedings

As always, the information provided is the result of the experiences of defendants who have been in dispute. It is NOT intended to replace professional legal advice and you should always see a solicitor about any claim against you. Remember to take the skeleton argument (in the Court Bundle section) with you.

If you get no response to your Letter Before Action or you have received a response to your Subject Access Request but you know it to be inadequate, then you can issue proceedings against the Business Transfer Agent to ask the court to Order them to comply with the Request and also claim damages (at the court’s discretion).

You can do this quite easily online by using the courts MoneyClaimOnline service which allows you to instigate proceedings. If your Business Transfer Agent do not settle the dispute before proceedings then you should expect to attend the final hearing.

The documentation for issuing court proceedings for this matter can be found in the court bundles section.
