As always, the information provided is the result of the experiences of defendants who have been in dispute. It is NOT intended to replace professional legal advice and you should always see a professional debt advisor, or solicitor about any claim against you.  You have just 14 days to respond to any Claim against you and another 14 days (28 days in total) to get help with a Defence Document. 

Remember to take the skeleton argument (in the Court Bundle section) with you.

The documents in this section are to help you put together an evidence bundle for a court hearing.

Every case is different so you should start by writing a witness statement (use the example one to start you off) and then get help with your Defence where you are known as The Defendant and the Business Agent is known as The Claimant. You will need to send 2 signed copies of the Defence to the correct Court – just the Defence, no ancillary evidence. Later, around 14 days before the Court Hearing, you will need to amend the Skeleton Argument so that it reflects your case.

Then you need to add in all the documents from the your own records and any you obtain from us at CEBTA to build up the evidence in your bundle.

When you have all of your paperwork together you will need to make 2 more copies of everything.

Then split everything into 3 piles and put them in the following order:-

1.  Skeleton Argument

2.  List of documents

3.  Document 1 from the list of documents

4.  Document 2 from the list of documents

5.  etc

Ensure that your witness statement and skeleton argument have been signed as well as any other documents that require a signature.

Send one complete bundle to the court – send Signed For

Send one complete bundle to RTA – send Signed For

The last bundle should contain all the original documents (not the copies) and this is your bundle to take to court with you.
