Step 5 – Making a Subject Access Request under the Data Protection Act

It may be beneficial (especially if court proceedings are instigated) for you to have full details of all information that RTA hold about you.

You can request this information by making a Subject Access Request under the Data Protection Act.

There are draft letters in the Library section under ‘Data Protection Act’.

You will need to send the letters via a Signed For method and the initial letter will need to include a cheque for £10. You are entitled to all information held about you and your business, including statements of accounts, letters to/from/about you, transcripts of telephone calls, etc.
a) Send the DPA Initial letter
b) If you get no response after 40 days then send the DPA Letter Before Action
c) If you get a response which includes some but not all information (or a letter saying that they’re not going to send you everything because they don’t have to (although they do!)) then send the DPA Clarification Letter
d) If none of the above result in the provision of all documents then you may instigate proceedings for damages and the recovery of the missing documents via www.moneyclaim.gov.uk . There are separate instructions for doing this.
